The federal appeals court decided on Tuesday that it would rehear the legal dispute concerning the executive power with an larger group of eleven justices. The court also vacated a earlier ruling from a three-judge panel that had sided with the federal government.

Ongoing Dispute Over Military Presence

This order represents the latest turn in a long-running court case over whether the former president has the legal right and justification to deploy state military units in Portland. Approximately two hundred troops have been in uncertainty since late September when the deployment effort was started in due to months of protests.

The administration has argued that federal officials at the ICE facility in the southern part of the city were under attack, while local authorities maintain that municipal police have control of the situation.

Recent Legal Actions

The Tuesday ruling came after a US district judge in the city issued two temporary restraining orders this month – one preventing the federal control of the Oregon national guard, and another stopping the use of any military personnel in the state, after efforts to circumvent the initial injunction by mobilizing troops from California.

On Monday, the ninth circuit panel had temporarily suspended the initial decision – permitting control of 200 Oregon national guard – but the subsequent injunction remained in place, preventing the actual deployment of the troops.

The latest ruling means the matter will be heard “en banc” – with both rulings under review together – by a group of eleven justices.

“This decision demonstrates that facts are important and that the courts are working to hold this administration accountable. The constitution limits the president’s power, and local populations cannot be treated as a training ground for unchecked federal authority,” stated the state attorney general in a statement.

“The judicial body is sending a clear message: the executive leader cannot send the armed forces into American urban areas without cause. We will continue protecting Oregon’s laws, values, and sovereignty as this case progresses and our fight continues in the judicial system.”
